          甲方因生產(chǎn)(工作)需要,招聘(以下簡(jiǎn)稱乙方)為甲方員工。根據(jù)《xxx中外合資經(jīng)營(yíng)企業(yè)法》、《xxx勞動(dòng)法》和《中外合資經(jīng)營(yíng)企業(yè)勞動(dòng)人事管理?xiàng)l例》的有關(guān)規(guī)定,經(jīng)甲、乙雙方協(xié)商,特簽訂本勞動(dòng)合同,以共同遵守。

          2.甲方必須執(zhí)行國(guó)家有關(guān)勞動(dòng)保護(hù)、女工特殊保護(hù)等法規(guī),采取勞動(dòng)保護(hù)措施,保護(hù)安全生產(chǎn)和乙方健康。甲方應(yīng)根據(jù)企業(yè)生產(chǎn)、工作的需要,發(fā)給乙方勞動(dòng)防護(hù)用品和保健食品。

          3.甲方實(shí)行國(guó)家現(xiàn)行工時(shí)制度。甲方應(yīng)嚴(yán)格控制延長(zhǎng)乙方的工作時(shí)間,確需加班加點(diǎn),應(yīng)發(fā)給乙方加班工資,每月加班不得超過36小時(shí)。

          4.員工患病或非因工負(fù)傷,給予個(gè)月的醫(yī)療期。醫(yī)療期滿仍未治愈的,經(jīng)雙方協(xié)商可再給予年以內(nèi)的醫(yī)療期。醫(yī)療期內(nèi)的醫(yī)藥費(fèi)和病假工資由甲方承擔(dān)。醫(yī)療期滿不能從事原工作的,甲方根據(jù)需要,安排乙方從事力所能及的工作。

          5.員工因工負(fù)傷,致殘或患職業(yè)病,醫(yī)療期醫(yī)療費(fèi)用,工資待遇,按國(guó)營(yíng)企業(yè)標(biāo)準(zhǔn),由甲方承擔(dān),直到作出醫(yī)療終結(jié),傷愈后由甲方安排力所能及的`工作。

          6.員工因工死亡,按國(guó)營(yíng)企業(yè)規(guī)定,由甲方負(fù)責(zé)支付死亡喪葬補(bǔ)助和職工供養(yǎng)直系親屬撫恤費(fèi)、生活困難補(bǔ)助費(fèi)。

          1.甲方根據(jù)生產(chǎn)情況負(fù)責(zé)制訂工藝流程、操作規(guī)程和有關(guān)生產(chǎn)標(biāo)準(zhǔn)或工作規(guī)范,乙方保證嚴(yán)格執(zhí)行。

          2.乙方對(duì)甲方生產(chǎn)(工作)有特殊貢獻(xiàn),應(yīng)給予乙方精神和物質(zhì)獎(jiǎng)勵(lì)。乙方違反勞動(dòng)紀(jì)律或犯其他錯(cuò)誤,甲方應(yīng)在堅(jiān)持思想教育的前提下,可給予相應(yīng)的處分或處理。甲方應(yīng)在作出辭退或開除決定前天通知工會(huì)。并報(bào)主管部門和勞動(dòng)部門備案。

          1.符合下列情況之一,甲方可以解除勞動(dòng)合同:

          (1)乙方在試用期內(nèi),發(fā)現(xiàn)不符合錄用條件的;

          (2)乙方患病或非因工負(fù)傷,在規(guī)定的醫(yī)療期滿后不能從事原工作或其他工作的;

          (3)乙方嚴(yán)重違反勞動(dòng)紀(jì)律;

          (4)企業(yè)宣告解散、破產(chǎn)或?yàn)l臨破產(chǎn)處于法定整頓期間的。

          2.乙方被勞動(dòng)教養(yǎng)和判刑的,勞動(dòng)合同自行解除。

          3.下列情況之一的,甲方不得解除勞動(dòng)合同辭退乙方:

          (1)乙方因病或非因工負(fù)傷在規(guī)定醫(yī)療期內(nèi)的;

          (2)乙方因工負(fù)傷或患有職業(yè)病,在治療、療養(yǎng)期間和醫(yī)療終結(jié)經(jīng)勞動(dòng)鑒定委員會(huì)確認(rèn)部分或者全部喪失勞動(dòng)能力的;

          (3)實(shí)行計(jì)劃生育的女職工在孕期、產(chǎn)期和哺乳期間的;

          (4)合同期限未滿又不符合本合同解除條件的。

          4.下列情況之一的,乙方可以向甲方提出解除勞動(dòng)合同:

          (1)經(jīng)國(guó)家有關(guān)部門確認(rèn),甲方勞動(dòng)安全、衛(wèi)生條件惡劣,嚴(yán)重危害乙方身體健康的。

          (2)甲方不按合同規(guī)定支付勞動(dòng)報(bào)酬的;

          (3)甲方不履行合同或違反國(guó)家有關(guān)法律、法規(guī),侵害乙方合法權(quán)益的;

          (4)乙方有正當(dāng)理由要求辭職并經(jīng)甲方同意的。

          1.除本合同第六條第1項(xiàng)(1)(3)和第2項(xiàng)人員外,甲方解除乙方合同應(yīng)在30日前通知乙方。

          2.對(duì)于終止勞動(dòng)合同的員工和按第六條第1項(xiàng)(2)(4)規(guī)定辭退的以及按第六條第4項(xiàng)(1)(2)(3)項(xiàng)規(guī)定辭職的,甲方應(yīng)根據(jù)乙方在甲方企業(yè)的工作年限,每滿1年發(fā)給相當(dāng)本人1個(gè)月實(shí)得工資的生活補(bǔ)助費(fèi)。

          3.對(duì)于按照本合同第六條第1項(xiàng)(2)規(guī)定辭退的,甲方除發(fā)給乙方生活補(bǔ)助費(fèi)外,還須發(fā)給乙方相當(dāng)于本人3至6個(gè)月實(shí)得工資的醫(yī)療補(bǔ)助費(fèi)。

          4.對(duì)于按照本合同第六條第1項(xiàng)(4)規(guī)定辭退的,甲方除發(fā)給生活補(bǔ)助費(fèi)外,還須發(fā)給乙方相當(dāng)于3至6個(gè)月實(shí)得工資的辭退補(bǔ)償金。

          5.對(duì)于按照本合同第六條第4項(xiàng)(4)規(guī)定,乙方有正當(dāng)理由向甲方提出辭職的,甲方一般應(yīng)予以同意,但應(yīng)在30日前向甲方提出,經(jīng)甲方批準(zhǔn)后可辦理解除合同手續(xù)。如經(jīng)甲方出資培訓(xùn),乙方應(yīng)賠償甲方一定數(shù)額的培訓(xùn)費(fèi)。

          任何一方違反勞動(dòng)(聘用)合同,給對(duì)方造成損失的,應(yīng)當(dāng)根據(jù)其后果和責(zé)任大小予以賠償。其中,責(zé)任屬于甲方的,應(yīng)繼續(xù)履行合同,同時(shí)負(fù)責(zé)賠償在合同中斷期間乙方的經(jīng)濟(jì)損失;責(zé)任屬于乙方的,賠償招工(招聘)和技術(shù)培訓(xùn)費(fèi)用。

          勞動(dòng)爭(zhēng)議發(fā)生后,當(dāng)事人可以向本單位勞動(dòng)爭(zhēng)議調(diào)解委員會(huì)申請(qǐng)調(diào)解,調(diào)解不成,當(dāng)事人一方要求仲裁的,可以向勞動(dòng)爭(zhēng)議仲裁委員會(huì)申請(qǐng)仲裁,當(dāng)事人一方也可以直接向勞動(dòng)爭(zhēng)議仲裁委員會(huì)申請(qǐng)仲裁。對(duì)仲裁裁決不服的,可以向人民法院提起訴訟。

          若需要員工在法定節(jié)假日加班,公司將根據(jù)本合同第4條中所列工資標(biāo)準(zhǔn)計(jì)算出該員工的每小時(shí)工資,并按照每小時(shí)工資標(biāo)準(zhǔn)的3倍支付加班工資。

          notwithstanding what provided hereof the company shall extend the working hours regardless of article and article in any of the following cases:

          若出現(xiàn)下列情況,無論是否符合本合同第條和第條中的規(guī)定,本公司均可延長(zhǎng)工作時(shí)間:

          a. immediate action which must be carried out in case of natural disasters, accidents or other events that will endanger the employee’s life, health, property, or safety;

          由于發(fā)生自然災(zāi)害、事故或其它危及該員工生命、健康、財(cái)產(chǎn)及安全的事件,必須采取緊急措施;

          b. urgent repair which must be carried out in case of breaking down of operation equipment, communication, transportation and other facilities which will endanger company business or public interest;

          由于運(yùn)營(yíng)設(shè)備、通訊設(shè)備、運(yùn)輸設(shè)備及其它設(shè)備發(fā)生故障,危害到本公司的業(yè)務(wù)或公共利益,必須進(jìn)行緊急維修;

          c. continuous of the operation or business of the company which shall not be interrupted on stipulated holidays and rest days.

          由于無法因?yàn)榉ǘㄐ菁俸碗p休日而中斷本公司持續(xù)開展的經(jīng)營(yíng)運(yùn)作或業(yè)務(wù);

          d. overhaul and maintenance of the equipment which shall only be made on stipulated holidays and rest days; and

          只能在法定休假和雙休日進(jìn)行的設(shè)備檢修與維護(hù);

          e. emergency operation assignment concerning national defence.

          由于國(guó)防原因需要采取緊急措施。

          article 9: discipline第九條:勞動(dòng)紀(jì)律 apart from the provisions of this contract the employee must respect all relevant laws and regulations of the people’s republic of china rules and regulations of the company and provisions of any relevant collective labour contract.

          除本合同所規(guī)定之條款外,該員工還須遵守^v^相關(guān)法律法規(guī)、本公司制定的規(guī)章制度,以及其它勞動(dòng)合同方面的相關(guān)規(guī)定。

          the employee must respect and execute any and all formal instructions given to him/her regarding the duties and responsibilities of his/her tasks of work.

          該員工須遵守并執(zhí)行一切與其工作職責(zé)有關(guān)的正式指令。

          in cases of an offence, gross misconduct, and or any violation of labour discipline the company will normally carry out the following procedure:

          若該員工出現(xiàn)過錯(cuò)、嚴(yán)重過失及/或其它違反勞動(dòng)紀(jì)律的行為,本公司一般依照以下程序?qū)υ搯T工進(jìn)行處罰:

          1 – oral warning 口頭警告

          2 – first written warning 第一次書面警告

          3 – final written warning 第二次書面警告

          4 – dismissal 開除

          however the company reserves the right to omit any of these stages as the case may be.

          然而,本公司有權(quán)根據(jù)實(shí)際情況對(duì)上述某些步驟進(jìn)行調(diào)整。

          the employee has the right to appeal against written warnings or dismissal to the labour dispute committee if any.

          該員工有權(quán)針對(duì)其受到的書面警告或開除決定向勞動(dòng)爭(zhēng)議委員會(huì)提出申訴(如需)。

          article 10: sickness & injury leave第十條:病假及傷假 the employee will be entitled to sickness and injury leaves in accordance with the relevant laws and regulations.

          該員工有權(quán)根據(jù)相關(guān)法律法規(guī)享受病假及傷假。

          the employee applying for sickness or injury leave shall fill in a ‘leave application form’ and get approval from his/her manager. leave for more than two (2) days shall be approved by the chief executive officer of the company and submitted to the office manager, human resources manager or their manager for verification and filing before going for leave.

          申請(qǐng)病假或傷假時(shí),該員工應(yīng)填寫“休假申請(qǐng)表”,并必須得到其上級(jí)主管的準(zhǔn)許。若該員工的休假超過兩(2)天,則需經(jīng)本公司首席執(zhí)行官允許,且應(yīng)在休假前將“休假申請(qǐng)表”提交至行政經(jīng)理、人力資源部經(jīng)理或直屬上級(jí)經(jīng)理以供審核及存檔。

          in case of any sudden sickness or injury the employee shall inform his/her manager no later than the end of the first day. a written confirmation shall be submitted to the office manager and human resources manager for verification and filing within two (2) days after he or she comes back to work.

          若該員工突發(fā)疾病或受傷,需在當(dāng)天結(jié)束前通知其上級(jí)經(jīng)理,并在返回崗位后的兩(2)個(gè)工作日內(nèi)將書面說明提交行政經(jīng)理及人力資源部經(jīng)理以供審核及存檔。

          if the employee is absent for more than one (1) week he/she must ensure that the chief executive officer are kept informed of the progress at weekly intervals.

          若該員工的病假超過一周,該員工必須每周向首席執(zhí)行官報(bào)告其病情狀況。

          the employee taking sickness or injury leaves for more than one (1) day must provide a medical certificate issued by a qualified doctor. failure or refusal to provide the certificate or providing false or inaccurate information will be deemed as a gross misconduct.

          若該員工休病假或傷假超過一天,必須提供由專業(yè)醫(yī)師出具的病假條。若該員工無法或拒絕提供病假條或提供虛假信息,將被視為嚴(yán)重過失。

          article 11: labour safety & hygiene第十一條:勞動(dòng)安全及勞動(dòng)衛(wèi)生保障 the company will establish a sound labour safety and hygiene facilities and shall strictly implement rules and standards of labour safety and hygiene of the people’s republic of china, conduct labour safety and hygiene education, prevent accidents and reduce occupational hazards.

          本公司將建立一套合理的勞動(dòng)安全衛(wèi)生保護(hù)措施,嚴(yán)格落實(shí)^v^勞動(dòng)安全衛(wèi)生制度和標(biāo)準(zhǔn),開展勞動(dòng)安全衛(wèi)生教育,防止事故發(fā)生,減少職業(yè)病危害。

          the company shall provide the employee with labour safety and hygiene conditions and necessary articles in conformity with the relevant laws and regulations.

          本公司將依照有關(guān)法律法規(guī)為該員工提供勞動(dòng)安全衛(wèi)生條件以及必要的設(shè)備。

          the employee shall have the right to refuse to carry out any dangerous operation forced upon him/her by management personnel in violation of the relevant regulations.

          若該員工的上級(jí)主管違反相關(guān)法律法規(guī),要求其從事危險(xiǎn)性工作,該員工有權(quán)拒絕。

          article 12: social insurances第十二條:社會(huì)保險(xiǎn) the company must join social insurance schemes for the employee in accordance with the relevant laws and regulations of the people’s republic of china and shall pay on time social insurance premiums to the social insurance institutions according to the standards set by the local authorities.

          本公司嚴(yán)格遵守^v^有關(guān)法律法規(guī)為該員工繳納社會(huì)保險(xiǎn),并且依照當(dāng)?shù)卣块T制定的標(biāo)準(zhǔn)將保險(xiǎn)費(fèi)按時(shí)、全額支付給社會(huì)保險(xiǎn)機(jī)構(gòu)。

          article 13: holidays

          第十三條:休假 the employee enjoys statutory holidays for official public holidays, wedding, and funerals in line with the relevant laws and regulations of the people’s republic of china.

          該員工依照^v^有關(guān)法律法規(guī)享受法定休假,包括法定節(jié)假日、婚假、喪假、產(chǎn)假。

          the employee is entitled yearly (for a full year worked) to a paid annual vacation of ten (10) working days exclusive of the statutory holidays.

          該員工在本公司工作滿一年后有權(quán)享受每年十個(gè)工作日的帶薪年假,不含法定節(jié)假日。

          the holiday’s reference period is from the first day of january to the thirty first day of december. holidays accrued during one period have to be taken on the following holiday period. for the first year of employment, holidays will be accrued at pro rata temporis.

          每年1月1日至12月31日作為一個(gè)休假年度,當(dāng)年未休的假期只可累積到次年使用。在本公司工作未滿一年的新員工可在次年享受年假,具體的年假天數(shù)按照其實(shí)際工作時(shí)間計(jì)算。

          after the employee completes five (5) years of continuous work for the company the employee is entitled yearly (for a full year worked) to one (1) further working day of paid annual vacation for each full year which the employee works for company, but the paid annual vacation shall not exceed twenty (20) working days in the aggregate.

          該員工在本公司任職滿五年后,在本公司每工作滿一年,每年可以增加一個(gè)工作日的帶薪年假,但每年帶薪年假累積最多不超過二十個(gè)工作日。

          all leave must be taken at times agreed with the chief executive officer of the company ten days in advance.

          所有休假必須提前10天向本公司申請(qǐng)并獲得首席執(zhí)行官的同意。

          article 14: exclusivity & non-competition第十四條:唯一性及非競(jìng)爭(zhēng)協(xié)定 the employee must devote in full all his/her working time to the company.

          該員工在本公司工作期間必須勤奮敬業(yè)。

          it is strictly forbidden for the employee to have any other professional activity for himself/herself or and relatives or and third parties even free of charge.

          嚴(yán)格禁止該員工在本公司任職期間為其自身及/或親屬及/或第三方提供任何有償或無償專業(yè)勞動(dòng)。

          the employee undertakes not to exercise directly or indirectly on behalf of any competitor to the company even as free of charge or for himself/herself any activity which may compete with the business of the company for one (1) year after the termination of the present contract. this article is not applicable if termination of the contract is due to company for other reasons than the ones covered by article 14 and article 15.

          該員工與本公司解除本合同后一年內(nèi)不得直接或間接地代表本公司的任何競(jìng)爭(zhēng)對(duì)手從事任何可能傷及本公司利益的有償或無償活動(dòng)。若由于其它原因而非本合同第14條和第15條解除本合同的,不適用本合同第條。

          the employee shall pay the company an amount of rmb10,000 to rmb100,000 as a penalty clause if he/she does not comply with article ., article ., and article . hereto. this amount does not include the possible actual damages which may be claimed by the company.

          若該員工違反本合同第條、第條及第條的規(guī)定,其必須向本公司支付1萬-10萬人民幣作為賠償。該筆賠償不包括本公司對(duì)可能造成的實(shí)際損害進(jìn)行索賠的金額。

          article 15: confidentiality第十五條:保密協(xié)定 the employee shall keep strictly secret and confidential and not to disclose to any third party any and all technical, economic, financial, client or marketing information acquired from the company and or obtained because of his/her activities in the company.

          該員工須嚴(yán)守公司機(jī)密,不得向任何第三方透露自本公司處獲得的及/或由于該員工在本公司任職而獲得的任何技術(shù)、經(jīng)濟(jì)、財(cái)務(wù)、客戶或市場(chǎng)信息。

          the employee shall not use any such information for any purpose whatsoever except within and for the tasks, duties, and responsibilities provided in this contract.

          該員工亦不得將上述信息用于本合同規(guī)定之工作職責(zé)以外的一切活動(dòng)。

          the employee agrees that any disclosure or non authorised use of such information shall be considered as a serious misconduct except in the case whereby the employee has received a prior written permission from the company management.

          該員工認(rèn)同,除非該員工已事先收到本公司管理部門發(fā)出的書面許可,否則,泄露上述信息或在未被授權(quán)的情況下使用上述信息將被視為嚴(yán)重過失行為。

          the employee shall comply with his/her confidentiality obligations pursuant to this article 15 for the whole term of this contract and duration of five (5) years after the termination of the contract.

          該員工在本公司任職期間以及在本合同解除后五(5)年內(nèi)應(yīng)當(dāng)按照本合同第15條的規(guī)定遵守保密協(xié)議。

          the employee shall pay the company an amount of rmb10,000 to rmb100,000 as a penalty if he/she does not comply with his/her confidentiality obligations pursuant to this article 15. this amount does not include the possible actual damages which may be claimed by the company.

          若該員工違反本合同第15條的規(guī)定,沒有盡到其應(yīng)盡的保密義務(wù),則該員工必須向本公司支付1萬-10萬人民幣作為賠償。該筆賠償不包括本公司對(duì)可能造成的實(shí)際損害進(jìn)行索賠的金額。

          article 16: responsibilities of the parties第十六條:雙方職責(zé) either of the parties shall perform its responsibilities under this contract strictly in accordance with the provision hereof.

          合同任何一方都應(yīng)按照本合同所規(guī)定的條款嚴(yán)格履行各自職責(zé)。

          either of the parties should bear responsibilities for compensation if it violates this contract, infringes upon the interests of the other party and causes damages to the other party.

          若合同任何一方違反本合同以及損害本合同另一方的利益并給本合同另一方造成損害,該方承擔(dān)違約責(zé)任。

          article 17: termination of the contract第十七條:合同終止 either of the parties shall be entitled to terminate this contract for reasons expressly provided by the relevant laws and regulations of the people’s republic of china. such termination of this contract shall comply with the proceedings provided by the relevant laws and regulations.

          合同任何一方均有權(quán)依照^v^相關(guān)法律法規(guī)終止履行本合同。本合同的終止須遵照有關(guān)法律法規(guī)操作進(jìn)行。

          furthermore the company may terminate the contract for any one of the following reasons:

          此外,在下列情況下,本公司可隨時(shí)解除本合同:

          a. the employee has a conflict between personal interest and the interest of the company in dealing with supplier, customers, and individuals of other organisations doing or seeking to do business with the company.

          該員工在與本公司的供貨商、客戶及其它機(jī)構(gòu)的人員開展業(yè)務(wù)或收集業(yè)務(wù)信息期間發(fā)生其個(gè)人與本公司利益上的沖突。

          b. the employee has asked for or received any advantage or benefits either in monetary or non monetary term of any kind form persons or organisations having business activities directly or indirectly with the company.

          該員工向與本公司有直接或間接業(yè)務(wù)往來的任何個(gè)人或機(jī)構(gòu)索取或收受任何貨幣或非貨幣形式的財(cái)物或好處。

          c. the employee fails to perform his/her responsibilities under articles 14 and article 15 of this contract.

          該員工違反本合同第14條和第15條的規(guī)定。

          d. the employee left from his/her work for more than five (5) working days without prior consent from the chief executive officer except in the case of force majeure which prevent the employee from informing the chief executive officer.

          該員工事先未經(jīng)首席執(zhí)行官準(zhǔn)許擅自離崗超過五個(gè)工作日,若因不可抗力導(dǎo)致該員工無法通知首席執(zhí)行官除外。

          the employee may also hand over a written notice of his/her resignation for personal reasons 30 days ahead. if the employee does not provide the company with one month’s notice, he/she should pay to the company one calendar month of salary and allowance mentioned in article 4 as the compensation.

          若由于其個(gè)人原因,該員工可提前三十天以書面形式提出辭職。若該員工沒有提前三十天向公司遞交辭呈,該員工將向公司支付依本合同第4條所規(guī)定的一個(gè)月的月工資及補(bǔ)助作為補(bǔ)償金。

          the company shall pay to the employee any compensation pursuant to relevant laws and regulations of the people’s republic of china in case of termination of this contract unless otherwise provided by the laws or resulting from the occurrence of the termination events agreed by parties hereof or resignation of the employee for personal reasons. the maximum amount of compensation by the company will not exceed one calendar month of salary and allowance mentioned in article 4

          若本合同解除,本公司將遵照^v^有關(guān)法律法規(guī)向該員工支付補(bǔ)償金,該補(bǔ)償金總數(shù)不超過本合同第4條所規(guī)定的一個(gè)月的月工資與補(bǔ)助總額。合同雙方依法另行約定解除本合同或者該員工出于個(gè)人原因提出辭職的除外。

          in case of termination of this contract due to fault of the employee or resignation of the employee for personal reasons:

          若因該員工的過失或該員工出于個(gè)人原因解除本合同,則:

          a. company need not pay to the employee the yearly bonus provided in article 5 hereto; and

          本公司無須向該員工支付本合同第5條規(guī)定的年終獎(jiǎng)金;

          b. the employee shall refund to the company all the expenses and costs for the training provided to the employee according to article 7 hereto.

          該員工應(yīng)按照本合同第7條的規(guī)定退還本公司為其提供培訓(xùn)投入的所有費(fèi)用。

          article 18: amendment of the contract第十八章:合同修訂 this contract may be revised upon agreement of both parties. any amendment to this contract shall come into force only after a written agreement has been signed by both parties.

          本合同經(jīng)合同雙方同意可作修訂。本合同任何修訂內(nèi)容須經(jīng)合同雙方簽署書面協(xié)議后方能生效。

          article 19: applicable law第十九條:適用法律 the formation, validity, and performance of this contract and disputes thereon shall be governed by the laws of the peoples republic of china.

          本合同的格式、有效期、履行、以及對(duì)本合同的爭(zhēng)議應(yīng)遵照^v^法律法規(guī)執(zhí)行。

          article 20: settlement of disputes第二十條:爭(zhēng)議的處理及解決 any disputes arising from the performance of or in connection with this contract shall be settled through friendly consultations between the parties.

          任何因履行本合同或由本合同相關(guān)事宜引發(fā)的爭(zhēng)議,應(yīng)由合同雙方友好協(xié)商解決。

          in case no settlement can be reached through consultations the parties can apply for mediation to the labour dispute conciliation committee established by the company, if any.

          若無法協(xié)商解決,合同雙方可根據(jù)需要向本公司組建的勞動(dòng)爭(zhēng)議管理委員會(huì)申請(qǐng)調(diào)解。

          if mediation can not be reached the parties may apply to arbitration to the relevant labour dispute arbitration committee.

          若無法實(shí)現(xiàn)調(diào)解,合同雙方可向相關(guān)勞動(dòng)爭(zhēng)議仲裁委員會(huì)申請(qǐng)仲裁。

          if a party disagrees with the arbitrage award rendered by such committee this party may file a suit in the baohe district people’s court within fifteen (15) days of being notified the said arbitrage award.

          若合同任何一方對(duì)上述勞動(dòng)爭(zhēng)議仲裁委員會(huì)給予的仲裁結(jié)果持有異議,該合同方可于接到仲裁結(jié)果后十五日內(nèi)向合肥市包河區(qū)人民法院提起訴訟。

          article 21: miscellaneous第二十一條:其它事宜 this contract shall be written in chinese and english versions. in a case of discrepancy of interpretation between the chinese and english versions the chinese version shall prevail.

          三.按期完成工作任務(wù),保證工作質(zhì)量。

          四.尊重中國(guó)的宗教政策。不從事與專家身份不符的活動(dòng)。

          五.尊重中國(guó)人民的道德規(guī)范和風(fēng)俗習(xí)慣。

          7、合同的變更、解除和終止

          一.雙方應(yīng)信守合同,未經(jīng)雙方一致同意,任何一方不得擅自更改、解除和終止合同。

          二.經(jīng)當(dāng)事人雙方協(xié)商同意后,可以變更、解除和終止合同。在未達(dá)成一致意見前,仍應(yīng)當(dāng)嚴(yán)格履行合同。

          三.聘方在下述條件下,有權(quán)以書面形式通知受聘方解除合同:

          (1)受聘方不履行合同或者履行合同義務(wù)不符合約定條件,經(jīng)聘方指出后仍不改正的;

          (2)根據(jù)醫(yī)生診斷,受聘方在病假連續(xù)30天后不能恢復(fù)正常工作的;

          四.受聘方在下述情況下,有權(quán)以書面形式通知聘方解除合同:

          (1)聘方未按合同約定提供受聘方必要的工作和生活條件;

          (2)聘方未按時(shí)支付受聘方報(bào)酬。

          8、違約金

          當(dāng)事人一方不履行合同或者履行合同義務(wù)不符合約定條件,即違反合同時(shí)。應(yīng)當(dāng)向另一方支付_________美元(或相當(dāng)數(shù)額的人民幣)的違約金。 受聘方因不可抗力事件要求解除合同,需出具有關(guān)機(jī)構(gòu)證明,經(jīng)聘方同意后,離華的費(fèi)用自理;受聘方若無故解除合同,除離華費(fèi)用自理外.還應(yīng)當(dāng)向聘方支付違約金。聘方因不可抗力事件要求解除合同.經(jīng)受聘方同意后,離華費(fèi)用由聘方負(fù)擔(dān);聘方若無故解除合同.除負(fù)擔(dān)受聘方離華費(fèi)用外,還應(yīng)當(dāng)向受聘方支付違約金。

          9、本合同附件為合同不可分割的-部分,與合同具有同等效力。

          10、本合同自雙方簽字之日起生效,合同期滿即自行失效。當(dāng)事人一方要求簽訂新合同,必須在本合同期滿90天前向另一方提出,經(jīng)雙方協(xié)商同意后簽訂新合同。受聘方合同期滿后,在華逗留期間的一切費(fèi)用自理。

          11、仲裁
