          甲乙雙方根據(jù)《^v^勞動(dòng)合同法》等法律、法規(guī)、規(guī)章的規(guī)定,在平等自愿、協(xié)商一致的基礎(chǔ)上,同意訂立本勞動(dòng)合同,共同遵守本合同所列條款。

          一、合同類型和期限

          第一條 甲、乙雙方選擇以下第 種形式確定本合同期限:

          第九條 乙方工作滿一年后,甲方應(yīng)按國(guó)家和云南省有關(guān)社會(huì)保險(xiǎn)的法律、法規(guī)和政策規(guī)定為乙方足額繳納基本養(yǎng)老、基本醫(yī)療、失業(yè)、工傷、生育保險(xiǎn)費(fèi)用;社會(huì)保險(xiǎn)費(fèi)個(gè)人繳納部分,甲方可從乙方工資中代扣代繳。

          六、勞動(dòng)保護(hù)、勞動(dòng)條件和職業(yè)危害防護(hù)

          第十條 甲方應(yīng)嚴(yán)格執(zhí)行國(guó)家和云南省有關(guān)勞動(dòng)保護(hù)的法律、法規(guī)和規(guī)章,為乙方提供必要的勞動(dòng)條件,建立健全工作規(guī)范和勞動(dòng)安全衛(wèi)生制度。

          第十一條 對(duì)乙方從事接觸職業(yè)病危害作業(yè)的,甲方應(yīng)按國(guó)家有關(guān)規(guī)定組織上崗前和離崗時(shí)的職業(yè)健康檢查,在合同期內(nèi)應(yīng)定期對(duì)乙方進(jìn)行職業(yè)健康檢查。

          第十二條 甲方有義務(wù)負(fù)責(zé)對(duì)乙方進(jìn)行業(yè)務(wù)技術(shù)、勞動(dòng)安全衛(wèi)生及有關(guān)規(guī)章制度的教育和培訓(xùn)。

          七、勞動(dòng)合同的變更、解除、終止和經(jīng)濟(jì)補(bǔ)償

          第十三條 經(jīng)雙方協(xié)商一致,可以變更本合同相關(guān)內(nèi)容或解除本合同。符合解除勞動(dòng)合同的情形出現(xiàn),甲方和乙方均可依照《勞動(dòng)合同法》的規(guī)定解除勞動(dòng)合同。

          第十四條 《勞動(dòng)合同法》等法律法規(guī)規(guī)定的勞動(dòng)合同終止情形出現(xiàn),本合同即行終止。

          八、其 他

          第十五條 乙方違反甲方規(guī)章制度,對(duì)甲方造成損失的,應(yīng)承擔(dān)相應(yīng)責(zé)任。

          第十六條 雙方協(xié)商一致約定的其他內(nèi)容:

          第十七條 本合同未盡事宜,雙方可協(xié)商解決;與今后國(guó)家法律、行政法規(guī)等有關(guān)規(guī)定相悖的,按有關(guān)規(guī)定執(zhí)行。

          第十四條 甲方應(yīng)在解除或者終止勞動(dòng)合同時(shí),為乙方出具解除或者終止勞動(dòng)合同的證明,并在15日內(nèi)為勞動(dòng)者辦理相關(guān)手續(xù)。乙方應(yīng)在甲方出具解除或者終止勞動(dòng)合同的證明后10日內(nèi)辦理工作移交,如涉及經(jīng)濟(jì)補(bǔ)償?shù)陌磭?guó)家有關(guān)規(guī)定在辦結(jié)工作交接時(shí)支付。

          八、勞動(dòng)爭(zhēng)議處理

          第十五條 雙方發(fā)生爭(zhēng)議,任何一方當(dāng)事人可向甲方所在地的勞動(dòng)爭(zhēng)議仲裁委員會(huì)申訴,由仲裁委員會(huì)依法調(diào)解或裁決。如對(duì)仲裁不服,向甲方所在地人民法院起訴,一方當(dāng)事人期滿不起訴但又不執(zhí)行裁決的,另方當(dāng)事人可向人民法院申請(qǐng)強(qiáng)制執(zhí)行。

          article 15 :in case disputes arise between two parties, either party can appeal to

          第九條(保密約定)article 9 confidentiality

          (一)雙方簽訂本合同后,乙方應(yīng)遵守甲方《保密條例》,不得泄露甲方秘密,不得在合同期內(nèi)再受聘其他任何單位從事與甲方相同或類似或有競(jìng)爭(zhēng)沖突的業(yè)務(wù)。不得引誘甲方的其他在職職工離職。

          party b shall, after signing of this agreement, observe party as confidentiality rules, and may not disclose any of party as confidential information; during the validity term hereof, party b may not engage in any business similar with or in competition with party as business for any other employer, and party b may not induce other employees working for party a to resign from party a.

          (二)乙方在合同期內(nèi),屬其崗位職務(wù)行為或主要利用甲方的物質(zhì)技術(shù)條件所產(chǎn)生的所有專利、版權(quán)和其他知識(shí)產(chǎn)權(quán)歸甲方所有,乙方無權(quán)進(jìn)行商業(yè)性開發(fā)。

          any and all patents, copyrights and other intellectual property rights produced by party b as his or her work duty or mainly by utilizing party as material during the validity term of this agreement shall be party as property, and party b is not entitled to any commercial rights pertaining thereto.

          (三)甲乙雙方另訂《保密協(xié)議》,具體確定雙方的權(quán)利義務(wù)。乙方在本合同存續(xù)期間和終止解除后承擔(dān)甲方《保密協(xié)議》中規(guī)定的保密義務(wù)。

          甲乙雙方約有固定期限的勞動(dòng)合同:自________年_______月_______日起至________年______月______日止。

          二、工作內(nèi)容及工作地點(diǎn)

          三、工作時(shí)間和休息休假

          (一)甲方對(duì)可能產(chǎn)生職業(yè)病危害的崗位,應(yīng)當(dāng)向乙方履行如實(shí)告知的義務(wù),并對(duì)乙方進(jìn)行勞動(dòng)安全衛(wèi)生教育,防止勞動(dòng)過程中的事故,減少職業(yè)危害。

          甲方應(yīng)當(dāng)每月至少一次以人民幣形式支付乙方工資,不得克扣或者無故拖欠乙方的工資。乙方在法定工作時(shí)間內(nèi)提供了正常勞動(dòng),甲方向乙方支付的工資不得低于甲乙雙方事先約定的( )。

          六、勞動(dòng)紀(jì)律

          甲方制定的勞動(dòng)紀(jì)律應(yīng)當(dāng)符合法律、法規(guī)、政策的規(guī)定,履行民主程序,并向乙方公示。乙方遵照?qǐng)?zhí)行。

          八、勞動(dòng)合同終止的條件

          經(jīng)甲乙雙方協(xié)商約定,出現(xiàn)下列情形之一的,可以終止勞動(dòng)合同:

          1.勞動(dòng)合同期滿的;

          2.甲方未能履行本合同規(guī)定的協(xié)議條款。

          九、勞動(dòng)爭(zhēng)議處理

          (一)甲乙雙方因履行本合同發(fā)生勞動(dòng)爭(zhēng)議,可以協(xié)商解決。不愿協(xié)商或者協(xié)商不成的,可以向本單位勞動(dòng)爭(zhēng)議調(diào)解委員會(huì)申請(qǐng)調(diào)解;調(diào)解不成的,可以向勞動(dòng)爭(zhēng)議仲裁委員會(huì)申請(qǐng)仲裁。甲乙雙方也可以直接向勞動(dòng)爭(zhēng)議仲裁委員會(huì)申請(qǐng)仲裁。提出仲裁要求的一方應(yīng)當(dāng)自勞動(dòng)爭(zhēng)議發(fā)生之日起六十日內(nèi)向勞動(dòng)爭(zhēng)議仲裁委員會(huì)提出書面申請(qǐng)。對(duì)仲裁裁決不服的,可以自收到仲裁裁決書之日起十五日內(nèi)向人民法院提起訴訟。

          (二)甲方違反勞動(dòng)法律、法規(guī)和規(guī)章,損害乙方合法權(quán)益的,乙方有權(quán)向勞動(dòng)保障行政部門和有關(guān)部門舉報(bào)。

          十、其他

          (一)勞動(dòng)合同期內(nèi),乙方戶籍所在地址、現(xiàn)居住地址、聯(lián)系方式等發(fā)生變化,應(yīng)當(dāng)及時(shí)告知甲方,以便于聯(lián)系。

          (二)本合同未盡事宜,均按國(guó)家有關(guān)規(guī)定執(zhí)行,國(guó)家沒有規(guī)定的,通過雙方平等協(xié)商解決。

          (三)本合同不得涂改。

          (四)本合同如需同時(shí)用中文、外文書寫,內(nèi)容不一致的,以中文文本為準(zhǔn)。

          (六)本合同一式兩份,甲乙雙方各執(zhí)一份。
